| (1) | A notice by the holder of a plant breeder's right of a surrender of their plant breeder's right in terms of section 39 must be submitted to the Registrar on a form obtainable from the office of the Registrar. |
| (2) | A duly completed and signed form, accompanied by the original certificate issued in respect of the plant breeder's right concerned, must be mailed, hand delivered or couriered to the office of the Registrar. |
