3. Lodgement of complaint

(1)A complaint shall be lodged in writing with the Registrar setting out in detailthe acts or omissions complained of by the complainant against the registered person.

 

(2)The complaint will be transmitted to the Council for consideration of the allegation and to prepare a charge sheet.

 

(3)The charge sheet setting out the details and nature of the charge will be delivered to the registered person to admit or deny the charge, in writing.

 

(4)If the registered person denies or admits a charge where a sanction comtemplated in section 24(4)(c) and (d) may be imposed in respect of such charge the Registrar shall transmit the complaint to the council.

 

(5)Upon receipt of the registered person's denial or admission of the charge in terms of subregulation (4) the councilmust appoint the tribunal to hear the matter.

 

(6)The Tribunal may in writing require a complainant to verify his or her complaint by affidavit and to provide such further information and documents relating to the complaint.

 

(7)A complaint once transmitted to the Tribunal, it shall not be with-drawn without leave of the Tribunal.
