| (1) | The Minister may in terms of section 5 (4) of the Act remove a Council member from office on the grounds of misconduct or incompetence upon receipt of a written complaint from:— |
| (a) | the Council; |
| (b) | a member of the public; |
| (c) | any organisation |
| (d) | any registered person of the geomatics profession. |
| (2) | The Minister shall, within 30 days from the date of receipt of the written complaint— |
| (a) | appoint suitably qualified person to conduct ban investigation and submit a report to the Minister; and |
| (b) | request written representation from the Council and the member concerned. |
| (3) | The Minister shall within 60 days after receipt of the report referred to in sub-regulation (2)(a) and having considered representations referred to in sub-regulation (2)(b)— |
| (a) | make a decision on the complaint; and |
| (b) | inform the member, the Council and the complainant in writing of the decision. |
| (4) | The Minister's decision referred to in sub-regulation (3)(a) shall be forwarded to the member concerned by registered or electronic mail. |
