| (1) | An employer shall supply in serviceable condition, free of charge, any uniform, overall, gumboots or other protective clothing which the employer requires the employee to wear or which by any law the employer is required to provide for the employee, and any such uniform, overall, gumboots or other protective clothing shall remain the property of the employee. |
| (2) | The employer must issue articles indicted in sub-clause (1) within seven days after an employee has commenced work provided that: |
| (i) | where an employee’s health and safety is at risks such articles must be issued immediately |
| (3) | No employer shall make any deduction from the wages of any employee in regard to any article provided to that employee in terms of sub-clause (1) unless the loss or damage occurred in the course of employment and was due to the fault of the employee; if |
| (4) | the employer has followed a fair procedure and has given the employee a reasonable opportunity to show why the deductions should not be made; |
| (5) | the total amount of the debt does not exceed the actual amount of the loss or damage; |
| (6) | the total deductions from the employee's remuneration in terms of this sub-clause do not exceed one-tenth of the employee's weekly wage. |
