| (1) | An operator must appoint or designate a Safety of Persons Officer. |
| (2) | The Safety of Persons Officer is responsible for ensuring the operator's compliance with the requirements of these Regulations in order to protect people within the railway system. |
| (3) | The Safety of Persons Officer must be delegated with the following responsibilities in accordance with the requirements of these Regulations: |
| (a) | Development, implementation and enforcement of the Safety of Persons policy, plan and procedures, which may be integrated with the Security Policy; |
| (b) | review of the Safety of Persons policy, plan and procedures where required; |
| (c) | ensuring that risk assessments are conducted, focussing on persons' safety; |
| (d) | ensuring the implementation of mitigation measures based on the recommendations made in the risk assessment report; |
| (e) | ensuring that incidents regarding persons' safety are reported to the Regulator; |
| (f) | ensuring the investigation of persons' safety incidents that take place directly or indirectly in connection with that operator's railway operations; |
| (g) | implementing safety measures, evaluating and improving the effectiveness of safety measures; and |
| (h) | conducting safety awareness programmes. |
