I, Pemmy Majodina, the Minister of Water and Sanitation, hereby declare in terms of section 98(6) of the National Water Act, 1998 (Act No. 36 of 1998) that—

 

(a)The Bo-Karoo Water User Association is established.

 

(b)The Association's name is the Bo-Karoo Water User Association.

 

The Bo-Karoo WUA would operate in the current area of operation of the transforming Smartt Irrigation Board. The area is in the Vaal-Orange water management area in the drainage area number D62A-J (Sub-Area 1) and D62A-M (Sub-Area 3) on the Orange River in the Emthanjeni local municipality proximate to Britstown Town. The area of operation commences from Richmond on the Southerly border and Victoria West on the South Westerly border then from Vosburg on the western border. Strydenburg on the Northern border, De Aar on eastern border with Britstown in the centre (Sub Area 2) will comprise the old Smartt Irrigation board borders which are from Doorskuilen 100 and Nieu Nietgedatch no 166 upstream from the dam wall and downstream it will include Giesenskraal on the west, portion 4 of Rosedale in the east and Tygerpoort A no 102 in the north, and has 1800 ha of registers water user for irrigation.

 

(c)Any other water resource(s) and/or waterworks situated outside the area described in paragraph (c) above, the Department of Water and Sanitation or the responsible authority may request the Water User Association to control, which are situated under Water Management Area number 4 in the National Water Resource Strategy 3 (NWRS3) in the Province of the Northern Cape, and

 

(d)Delegation of powers and functions of the Water User Association is per the delegations of 31 March 2023 which will be provided to the Water User Association.

 

(e)The constitution of the Bo-Karoo Water User Association has been approved.
