| (1) | An applicant or agent must, upon receipt of an annual fee invoice from the Registrar, pay the annual fee in accordance with section 30 for a plant breeder's right that has been granted in terms of section 28. |
| (2) | The annual fees payable are determined by the Minister by notice in the Gazette. |
| (3) | Proof of payment of the annual fee must be sent electronically, hand delivered or couriered to the office of the Registrar. |
| (3) | An annual fee is payable for the duration of the plant breeder's right and failure to pay the annual fee may result in the cancellation of the plant breeder's right in accordance with section 38. |
